Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/11/2016 The petitioner has filed this petition aggrieved by the order by which, he has been discharged from the offences but complaint has not been dismissed. 2.

The Court below has considered petitioner's application for dismissal of the complaint on the ground that in view of the report of the Central Food Laboratory, case is not made out. It being a case of warrant trial, the Court has committed no illegality in passing the order of discharge. Prayer for dismissal of complaint against all other accused is misconceived in law. Therefore, there is no illegality in the order.

The petition is accordingly dismissed.
