1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.164/2020 registered in Police Station Urla, Raipur District Raipur C.G. for the offence punishable under Section 302 of the I.P.C.

2. As per the prosecution case, applicant has allegedly committed murder of one Shankar Sen by assaulting him by hand and fist. There are three eye-witnesses who have

MCRC No. 2774 of 2021 seen the occurrence.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering the quality of evidence, I am not inclined to release the applicant on bail at this stage.

5. Accordingly, the bail application is rejected, however liberty is reserved in favour of the applicant to revive the prayer after examination of three eye witnesses namely; Dulari Bai, Rajkumar Sen and Shail Yadav.
