Judgment on Board By Prashant Kumar Mishra, Ag. CJ 10/04/2019
1. Challenging promotion of the respondent No.6 i.e. Harish Shashti from the post of Assistant Grade-III to the post of Assistant Grade-II, petitioner preferred the writ petition on submission that since he was working on daily wages in the Department from 1997 he was senior to the respondent No.6 who was directly recruited on 18.04.2013.
2. Petitioner being a daily wager having been regularized on 03.06.2016 cannot claim seniority over the private respondent, who was recruited much prior to the date of regularization of the petitioner. The writ petition has rightly been dismissed by the Single Bench, therefore, there is no substance in this writ appeal and accordingly the same is liable to be and is hereby dismissed.
