The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 45/2015 registered in Police Station Mandir Hasoud, Dist. Raipur (C.G.) for offence punishable under section 307, 34 of IPC & u/s 25, 27 (1) of Arms Act.

Case of the prosecution, in brief, is that present applicant along with other co-accused persons assaulted complainant Gopi Chaturvedi by sword/rod, by which, he suffered grievous injury, which was sufficient to cause death.

Learned counsel for the applicant submits that applicant has not committed any offence. He has been falsely implicated in the case. Complainant has burned out the house of one of the accused Sadhuram

Chandrakar wherein dispute arose. He further submits that similarly placed co-accused Raja Dhruv and Sadhuram has been enlarged on bail in M.Cr.C. No.4492/2015 by the coordinate bench of this court on 8/09/2015, therefore applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail, however do not dispute the fact that similarly placed co-accused has been granted bail.

Taking into statement made and the fact that similarly placed coaccused Raja Dhruv and Sadhuram has been enlarged on bail in M.Cr.C. No.4492/2015, on the ground of parity, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
