Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 12/07/2017 Learned counsel for the petitioner, at the outset, submits that Uttam Kumar Bareth, who was next to the petitioner in the merit list, filed an appeal before this Court and vide order dated 14/07/2016 passed in W.A. No.490/2015, the appeal was allowed and a direction was issued to offer appointment. Therefore, in the present case also, the respondents may be directed to consider the case of the petitioner.

Learned State counsel submits that as the waiting list has run its validity, appointment cannot be offered.

In view of the order passed by this Court in W.A. No.490/2015, it is clear that the appellant therein was offered appointment who was next to the name of the petitioner in the order of merit. Therefore, in these circumstances, respondents shall also issue necessary orders offering appointment to the petitioner.
