1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 436/2017 registered at Police Station Kurud, Police Chowki Birjher, Distt. Dhamtari (C.G) for the offences punishable under Sections 304-B, 34 of IPC.
2. As per the prosecution case, one Vimla Bai was married to Applicant No.1 Parasmani Sahu on 09.05.2016 and she died of burn injuries on 18.09.2017. It is alleged that after the marriage, she was subjected to torture for demand of dowry by the family members i.e., husband and Dhyanchand Sahu (Applicant No.2). Since Vimla Bai suffered unnatural death, offence is alleged to have been committed.
3. Learned counsel for the applicant submits that the applicants
have been falsely implicated and there is no evidence to connect the applicants with the crime.
4. Per contra, learned State Counsel opposes the bail application. .
5. Perused the statements of witnesses Rekha Bai, the mother and Chunnu Sahu the father. Considering their statements, I am not inclined to allow this bail application. Accordingly, it is dismissed.
