From the record it appears that the impugned judgment was earlier assailed by the appellant in Criminal Appeal No. 823/2006 and the said appeal has already been dismissed by this Court vide judgment and order dated 10/01/2013. Counsel for the appellant and the State both have verified the previous record and they submit that the earlier preferred appeal by the appellant has already been decided.
