State Of Chhattisgarh Through P.S. Kharsiya, Distt.-Raigarh (CG) ---Respondent 16/08/2017 Ms. Purnima Singh, counsel for the appellant. Shri Sangarsh Pandey, Dy. G.A. for the State. Learned counsel for the appellant submits that the appellant has been arrested on 24/09/2005 and thereafter he was not extended the benefit of bail. The conviction was for 10 years RI under section 376(2)(f) of IPC and fine of Rs.5000/- was imposed and in default of payment of fine, further RI for 5 months was ordered and under Section 450 of IPC, 5 years RI was ordered and fine of Rs.5000/- was imposed and in default of payment of fine, further RI for 5 months was ordered. Both the sentences were ordered to run concurrently. Since the appellant was lodged in jail, as such he has suffered jail sentence of 10 years.

Considering the same, learned counsel for the appellant do not want to press the appeal on merits as the appellant has already suffered his jail sentence. Perused the file of the lower court. It appears that appellant has suffered the jail sentence and learned counsel for the appellant do not want to press the appeal on merits.
