1. This is an application filed under Section 439 Cr.P.C. for grant of bail to the applicants, who have been arrested in connection with Crime No. 610/2017 registered at Police Station Durg, District Durg, Chhattisgarh for the offence punishable under Sections 419, 420, 467, 468, 471/34 of Indian Penal Code.

2. The present applicants are in jail since 02.09.2017 in connection with the aforesaid Crime number.

3. As per the prosecution case, report was made by Khemu that the present applicants along with his son Surendra personified his son as Khemu and executed a sale-deed in favour of Jyoti Agrawal.

4. The learned counsel for the applicants submits that after investigation the charge sheet has been filed, but charges has not yet been framed. He further submits that the present applicants are

in jail since 02.09.2017 and thus prayed for releasing the applicants on bail.

5. The State counsel opposed the bail application.

6. Considering the facts and circumstances of the case and taking note of the fact that the applicants are in jail since 02.09.2017 so also considering the fact that the charges has not yet been framed, this Court is of the opinion that prima facie a fit case has been made out for grant of bail to the applicants. Accordingly, the present application for grant of bail is allowed.

7. It is directed that the applicants shall be released on bail on their furnishing a personal bond in the sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned Court for their appearance before the said Court as and when directed.
