Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 0 5 /0 2 /201 (1) Decree for possession has been passed in favour of the petitioners by the trial Court in Civil Suit No.50-B/83 vide order dated 21.09.1983; and this Court has already directed for execution of decree by order dated 12.12.2011 passed in W.P. (C) No. 7546/2011, which states as under:- "2. Courts are required to execute decree passed by itself as early as possible to give effect judgment which has been passed by the Court, with these observations petition stands disposed of with following directions that
3rd Civil Judge, Class-2 Durg shall decide the execution proceeding as early as possible preferably within 6 months from the date of filing of copy of order on behalf of the petitiner. Parties shall cooperate Court in proceeding, in case of any non-cooperation or reluctancy on behalf of any party Court below shall take coercive step to dispose of execution proceeding. No order as to costss."
(3) In view of above, the petitioner is at liberty to proceed for execution of the decree in accordance with the decree passed by the trial Court.
(4) With the aforesaid observations, the writ petition stands finally disposed of.
