The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 384/2015 registered in Police Station Mohan Nagar, Durg, Civil and Revenue District Durg (C.G.) for offence punishable under section 420 of IPC.

As per the prosecution case, the applicant was running aJai Ambe Shikshan Samiti and was running institute under the name and style National Educational Academy and stated that they were providing B.Ed. degree to the students and the academy is affiliated to Karnataka State Open University which is been recognized. Consequently, received Rs.60,000/- to 80,000/- from 800 students. Subsequently, when the report was made by a batch of 100 student, the matter is being investigated. 3.

Learned counsel for the applicant submits that Jai Ambe Shikshan Samiti which is society runs the National Educational Academy is affiliated

to Karnataka State Open University and the degrees are recognized and therefore virtually no fraud has been committed by the applicant. He further submits that as many as students have been benefited by the degree and has been working in different institute and therefore he submits that applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail and would submit that applicant even if after death of his father has issued false letters with his signature as his father died on 2/03/2015 and letters subsequently were issued on 18/08/2015 and further submits that institute is not recognized by the State.

Having regard to the fact that 100 students have made a report that they have been deceived and have paid the amount of Rs.60,000/- to 80,000/- to get B.Ed. degree. The primary evidence is collected which establishes the fact that degree of Karnataka State Open University is not recognized in State of Chhattisgarh, however this part was suppressed and it was published that degrees so issued are also recognized in government job. Taking into the fact that matter is still under investigation and the nature of allegations against this applicant, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
