Justice Rajani Dubey Order On Board 13/05/2020 The applicants have filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as they are in custody in connection with Crime No. 123/2020 registered at police station Jaalbandha, Khairagarh, District Rajnandagaon (CG) for the offence punishable under Sections 188 and 34 IPC. As per prosecution case, the applicants have violated and disobeyed to the order duly promulgated by the Public Servant during the lock down.
Counsel for the applicants submits that the applicants were
innocent and they have been falsely implicated in the case. She further submits that they were searching for their cattle and were not aware of the lock down.
On the other hand State counsel opposes the bail application. Taking into consideration the submissions of the counsel for the parties and nature of offence, I am inclined to enlarge them on regular bail. Accordingly, their application filed under Section 439 of the Code of Criminal Procedure is allowed.
It is directed that in the event of the applicants' furnishing a personal bond in the sum of Rs. 10,000/- with one local surety each for the like sum to the satisfaction of the concerned Court on the condition that they shall appear before the trial court regularly on each and every date of hearing unless and until exempted, they shall be released on bail.
