Hon'ble Shri Justice Goutam Bhaduri Order On Board 22.05.2020

1. The present writ petition has been filed for the following reliefs :- (a) That this Hon'ble Court may kindly be pleased to direct the respondents authority to consider the case of the petitioner as per the memo issued by the respondent No. 2 on 18.03.2020 further, be pleased to allow the petitioner continue in service accordingly as per Annexure P/1.

(b) That this Hon'ble Court may be pleased to direct the respondent No. 5 herein forbear from giving effect to the final order of superannuation till proper order is being passed by the respondent No. 1.

(c) Any other relief, which this Hon'ble Court may deem fit and proper according to the facts and circumstances of the petition.

2. It appears that during the course of time, since the letter dated 18/03/2020 (Annexure P/1) has not been given effect to and the petitioner appears to have been retired on 21/04/2020 on attaining the age of superannuation, under these circumstances, no relief shall be granted to the petitioner in this petition. However, the petitioner shall be at liberty to file a better petition incorporating all the facts of subsequent event and also challenge the order passed, if any.
