I have perused the impugned order and the material on the record of this appeal Vide impugned order dated 02/05/2017, application under Order 39 Rule 1 & 2 of CPC, 1998 preferred by the appellants/plaintiffs has been rejected by the trial Court. During arguments, counsel appearing for both the parties have prayed that the Trial Court may be directed to frame issues within one month and further may be directed to decide the civil suit within 6 months from the date of framing of issues for the very purpose.
Considering the joint submissions made by both the parties, the trial Court is directed to frame issues preferably within one month from the date of receiving of the certified copy of this order and decide the case preferably within 6 months from the date of framing of the issues.
Parties are directed to maintain status-quo and they are further restricted that no further alienation shall be made in the suit property during pendency of the suit.
