On the allegation of violation of interim order dated 20.09.2016, notices were issued in this contempt petition. In the reply on affidavit by the respondents, it has been stated that the petitioner has been alloted work connected with teaching and for this purpose, document (Annexure R-2/8) has been placed on record. Though, the petitioner does not dispute this document but he disputed the nature of magnitude of job alloted to him. This cannot be a ground for initiating contempt proceedings. The other ground for initiating proceeding for contempt is that full salary for the month of September, 2016 has not been paid though interim order was passed by this Court on 20.09.2016. 2.
Learned counsel for the respondents submits that a part of the salary in the month of September, 2016 has been paid considering the
interim order of the Court passed on 20.09.2016. 3.
Considering the aforesaid submissions and that the writ petition is pending before the Court, leaving it open for the petitioner to claim disputed salary prior to the date of passing of the interim order, rule is discharged. The contempt petition is closed.
