1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.233/2021, registered at Police Station Supela District Durg C.G. for offence punishable under Sections 385, 452, 506 of the I.P.C.

2. Complainant Gurmeet Singh has been alloted a fair price shop, therefore, at 7:30pm on 23.3.2021, applicant went to

the house of Gurmeet Singh, to put him in fear of injury and demanded Rs.10,000/- per month, if he desires to run the fair price shop. The applicant made this statement to the complainant by saying that the shop should have been alloted to him but complainant has obtained the allotment, therefore, he should pay Rs.10,000/- per month.

3. Learned counsel for the applicant submits that previous dispute between the applicant and the complainant is going on for which writ petition was preferred in the High Court bearing WPC No.2841 of 2020. The present complaint is a counter blast to the previous litigation between the parties,

4. Learned State counsel would oppose the prayer for grant of anticipatory bail.

5. Considering the entire fact situation of the case , I am inclined to extend the benefit of anticipatory bail to the applicant.

6. Accordingly, the anticipatory bail application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (i)he shall make himself available for interrogation by a police officer as and when required;

(ii)he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) the applicant shall not influence the witnesses during pendency of the trial.
