The petitioner has filed this petition challenging the impugned transfer order dated 23.11.2016, by which, he is being sent to parent Municipality.

Learned counsel for the petitioner submits that the petitioner is going to retire on 31.03.2017.

Present is not a case that the petitioner has been transferred within a short period of posting at Bilha. The petitioner has already been given notice of retirement on 17.10.2016 with an option to proceed on leave.

Considering the aforesaid situation, I do not find the transfer order will any manner, cause any prejudice to the petitioner. The petitioner is being sent to his parent Municipality because his pension case will have to be settled only by parent Municipality and not by Municipality where he is presently working. Therefore, the transfer order appears to be beneficial to the petitioner and further that Bhatapara is very

near to Bilha, therefore, in these circumstances, I do not find any ground to interfere with the order impugned. However, it will be open for the petitioner to seek indulgence of the authority to allow him to continue till his retirement at his own peril. 5.
