Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 21/02/2017 Heard.
1. In this contempt petition, earlier notices were issued to the respondents. Respondents have come out with the stand that the petitioner had joined at Akaltara without there being proper relieving from earlier place of posting and even the petitioner did not handover the relevant records.
2. It is submitted that it is only when the petitioner would submit the necessary records that the petitioner would be entitled to LPC and salary.
3. The stand of the respondents does not appear to be as an act towards willful disobedience of the order of the Court. In fact, these facts were not before the Court when the order was earlier passed in the petition of the petitioner.
-2Therefore, in these circumstances, I am not inclined to hold that there is any willful disobedience of the order of the Court.
4. Contempt petition is therefore dismissed leaving it open for the petitioner to submit records relating to Nagar Panchayat, Pathariya, to the Officer-in-Charge holding the affairs of Nagar Panchayat, Pathariya. Sd/--- (Manindra Mohan Shrivastava) Judge Praveen
