Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 22-03-2018 in connection with Crime No.79/2017 registered at Police Station Gol Bazar, District- Raipur, Chhattisgarh for the offence under Section 420, 468, 471 of the IPC. 2.

It is submitted on behalf of the applicant that the applicant has been falsely implicated in this case. He is in jail since 22-03-2018. Similarly placed accused persons have been granted bail in similar cases. There is no evidence against this applicant in the material present in the charge sheet filed against him. Name of this applicant has appeared in the memorandum statement of one of the co-accused persons and there is no such seizure made from this applicant to involve him in the crime registered against him. Hence, it is prayed that the applicant may be granted regular bail. 3.

Learned counsel for the State/non-applicant opposes the application. 4.

Heard learned counsel for both the parties and perused the case diary. 5.

According to the prosecution case, an advertisement was floated by Jila

-2Panchayat Raipur inviting applications for appointment to the post of Librarian, Teachers etc. Co-accused Kuleshwar filed an application for the said appointment submitting his credentials. The mark-sheet filed by him showing his qualification of B.Lib. I.Sc. was found forged on verification, hence, the FIR was lodged. The name of this applicant has appeared in the memorandum statement given by co-accused Kuleshwar.

Looking to the evidence that is proposed against this applicant for prosecution against him, I am of this view that the applicant deserves to be granted regular bail.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 8.
