Perusal of the record would show that appellant was arrested on 21/08/2008. Trial court record also shows that appellant was not extended benefit of bail. Finally the appellant was convicted under Section 436 of IPC and sentence of 5 years was ordered and fine of Rs.100/- was imposed and in default of payment of fine, further RI for 1 month was ordered. Despite several calls no one appears on behalf of the appellant. It appears that appellant is not interested in prosecuting this appeal on merits. Taking into facts of this case and the appellant has suffered his jail sentence and he was not enlarged on bail, consequently appeal stands dismissed as abated.
