The limited prayer that the petitioner makes at the outset is that against the order of suspension dated 30.01.2021 the petitioner has already preferred a Departmental Appeal under Rule 23 of Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 on 17.03.2021, however, till date the appeal has not been decided.

The counsel for the State submits that because of lock-down situation that was prevailing in the State the appeal could not be decided, but the same shall be definitely decided at the earliest.

Given the facts and circumstances of the case, the writ petition stand disposed of directing the respondent No.1 to take a decision on the appeal of the petitioner against the order of suspension at the earliest preferably within a period of 45 days from the date of receipt of copy of this order.
