---- Petitioner
Versus
• State Of Chhattisgarh Through Station House Officer, Police Station Bhilai Nagar, District, Durg, Chhattisgarh.
---- Respondent For Petitioner :
Shri B. P. Singh, Advocate For Respondent/State :
Shri Manish Nigam, PL S.B. :
Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 02/01/2017 Heard.
2.
Learned counsel for the applicant submits that the trial Court has framed charges only under Section 6 of the Protection of Children from Sexual Offences Act, 2012. However, even after two years of arrest, till date, the prosecution has proceeded with snails pace and not a single prosecution witness has been examined, therefore, the applicant may be granted bail. 3.
On the other hand, learned State counsel opposes the bail application. 4.
Taking into consideration the nature of allegation against the applicant and that minimum sentence of 10 years is provided for alleged commission of offence, at this stage, I am not inclined to grant bail to the applicant only on the ground of delay in trial. However, the trial Court is directed to expeditiously dispose off the trial as early as possible without granting unnecessary
adjournment to any of the parties.
5.
With the aforesaid direction, the bail application is rejected at this stage. SD/- (Manindra Mohan Shrivastava) Judge Tumane
