1. Considering the fact that the Revision Petition has been preferred against the judgment of acquittal passed by the Lower Appellate Court, this Court is of the opinion that the Revision Petition would not be maintainable. It should have been duly constituted appeal with an application seeking leave to appeal against the judgment.

2. Learned Counsel for the Revisioner prays for withdrawal of the Revision Petition with a liberty to prefer a Cr.M.P. challenging the impugned judgment.

3. The present Revision Petition accordingly stands dismissed as withdrawn.

4. Subject to the Revisioner furnishing photocopy of the

impugned order the certified copy of the impugned order shall be returned to the Revisioner.
