2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.27/2020 registered at Police Station Supela, District Durg (CG) for the offence punishable under Sections 420, 489(B) of the IPC.
3. The applicant purchased mobile phone belonging to the present complainant Santosh Kumar Prajapati and one Ekta Tiwari in two separate transactions. He paid Rs.17,500/- to Santosh Kumar Prajapati, which was later on found to be counterfeit currency notes of Rs.500/- denomination. Similarly, he paid Rs.9500/- by way of 19 counterfeit currency notes of Rs.500/- denomination to Ekta Tiwari, In the crime registered on the complaint of Ekta Tiwari, the printer used for printing counterfeit currency notes and four counterfeit currency notes of Rs.500/- have been recovered from the present applicant, whereas, in the present case, all the counterfeit currency notes have been recovered from complainant Santosh Kumar Prajapati, as the notes were handed over to him by the present applicant as the price of the mobile phone.
4. The applicant has already been released on bail in MCRC No.2602/2020 vide order dated 11.8.2020, which was arising out of Crime No.42/2020 of the same Police Station registered on the complaint lodged by Ekta Tiwari.
5. Considering that the applicant has been released on bail in similar offence, this Court is inclined to release the applicant on
regular bail in this case too.
6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
