The petitioners approached this Court with following prayers:- 10.1 "That, this Hon'ble Court may kindly be pleased to set aside/quash the impugned notice inviting tender No.122 dated 30-10-2017 (Annexure P-1) and direction may kindly be issued to the respondents to

invite fresh notice for tender suitable with the condition proportionate to the requirement of the advertisement.

10.2 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deem-fit and appropriate."

Learned counsel for respondents No.2 & 3 have put forth their version on 29-01-2018 to the effect that the matter has become infructuous as the notice inviting tender No.122, dated 30-10-2017 (Annexure P-1) has already been cancelled by the respondents No.2 & 3-Housing Board and a copy of the said proceedings is produced as Annexure R-2/1.

In the above circumstances, no cause of action survives in the instant petition.

Accordingly, this petition is dismissed as having been rendered infructuous.
