Apprehending arrest in connection with Crime No.221/2018 registered at Police Station- Civil Line, Bilaspur (C.G.) for the offence punishable under Section 294, 323, 506, 327 & 34 of Indian Penal Code, the applicant has preferred this first bail application under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail.

As per the prosecution case, a report was made by one Rameshwar who is Conductor of the Bus bearing No.C.G. 09 F 0160 and was going from Bilaspur to Kawardha that the applicant along-with others came, stopped the vehicle and demanded money and having been refused, he was abused and assaulted. 3.

Learned counsel for the applicant submits that the complainant Rameshwar owed money from the applicant, which was demanded and having not been paid, the false report has been made; therefore, the applicant may be given the benefit of anticipatory bail.

Per contra, learned State counsel opposes the prayer for grant of anticipatory bail.

Perused the statement of the victim and also the medical report, which is positive. Considering the same, this is not a case where the benefit of anticipatory bail can be extended to the applicant. 6.
