Sam Koshy Order On Board 28/02/2017 Counsel for the petitioner prays for disposal of the writ petition with a direction to the respondent no.2 to take a decision on the resolution which has been forwarded by the Chief Municipal Officer, Municipal Council, Kanker i.e. respondent no.2 dated 13.10.2016 Annexure P-6. 2.

Counsel for the petitioner submits that the proposal for promotion of the petitioner was sent to the Director on an earlier occasion but the same was returned back on the ground of change of setup. Thereafter, respondent no.4 again has passed a resolution in the light of the earlier

setup stating that the vacancy arose under the pre revised stage and the consideration was also before the revised setup was brought into force and the same was forwarded to respondent no.2 vide order dated 13.10.2016 which is pending for consideration. 3.

State counsel does not have any objection if the writ petition is disposed of with a limited direction to the respondent no.2 for taking a decision on the said resolution sent by respondent no.4. 4.

Accordingly, the present petition is disposed of with a direction to respondent no.2 to take a decision on the resolution dated 13.10.2016 Annexure P-6 sent by respondent no.4 for approval. Let this exercise be done within a period of 90 days from the date of receipt of copy of this order.
