Learned Counsel for the petitioner submits that he may be permitted to withdraw the instant petition with liberty to file appropriate application for the grounds mentioned in the instant writ petition before the executing Court and same may be disposed of as per provisions of law.

As submitted there is no necessity to notice the respondent in the matter.

The instant writ petition(227) is disposed of with liberty to the petitioner to file appropriate application before the executing Court for the grounds raised in the instant writ petition.

The executing Court is directed to dispose of the application, if filed, within 30 days from today according to law. It is further made clear that the order passed on 19.8.2015 in Misc. Civil Case No. 6/2015 shall not come in the way for disposal of the application of the petitioner.

The petition is disposed of.
