The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 107/2015 registered in Police Station Deepka, District Korba (C.G.) for offence punishable under section 354, 294, 323 of IPC and Section 8 of Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case on 24/09/2015 the prosecutrix along with her mother went to the market, there the applicant touched the cheek of the prosecutrix and when it was opposed by mother of the prosecutrix, she was assaulted by the applicant.

Learned counsel for the applicant submits that applicant is in jail since 27/09/2015 and considering the nature of the offence, applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

I have gone through the case diary. Charge sheet in this case has been filed. Considering the detention of the applicant and taking into account degree of allegation, way the offence is committed, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
