NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No.6787 of 2016 • Ganga Singh Thakur S/o Late Laxman Singh Thakur Aged About 50 Years Working As Assistant Revenue Inspector Pathariya, R/o Ward No. 9, Shanti Nagar, Pathriya, District-Mungeli, Chhattisgarh ---- Petitioner
Versus
1. State Of Chhattisgarh S/o Through Secretary, Department Of Urban Administration And Development, Mahanadi Bhavan, Mantralaya, Naya Raipur, District- Raipur, Chhattisgarh
2. Director, Urban Administration And Development Department, Directorate, Raipur, District-Raipur, Chhattisgarh
3. Chief Municipal Officer, Nagar Panchayat Pathariya, District Mungeli, Chhattisgarh
4. Chief Municipal Officer, Nagar Panchayat Takhatpur, District- Bilaspur, Chhattisgarh ---- Respondents For Petitioner :
Shri Manish Upadhyay, Advocate For Respondent/State :
Shri D. R. Minz, Dy.GA S.B. :
Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 15/12/2016 Heard.
2.
The transfer order is under challenge in this petition mainly on the ground of frequent transfer.
3.
Learned counsel for the petitioner submits that the petitioner was transferred from present place of posting i.e. Pathariya to Takhatpur within a period of two months without showing any specific reason.
3.
On the other hand, learned State counsel submitted that under the new policy, the employees are being sent to their original Municipality, wherefrom they were initially appointed.
4.
Though, the impugned transfer order appears to be in the nature of frequent transfer, by which, the petitioner has been transferred from one place to another within a period of few months, but taking into consideration that the parent Muncipality i.e. Takhatpur, where the petitioner is being sent from Pathariya, there is very short distance between both the places, as such, there is no case of severe hardship caused to the petitoner. 5.
In view of above, I am of the opinion that otherwise also, there is no specific illegality or malafide in the impugned order. 6.
In the result, the petition is dismissed.
