Versus

• Secretary, Regional Transport Authority Sarguja, Ambikapur, District Sarguja, (Chhattisgarh) ---- Respondent And WPC No. 2002 Of 2015 • Anshul Shrivastava S/o Shailendra Shrivastava, Aged About 23 Years R/o Darripara, Ambikapur, District Sarguja, Chhattisgarh. ---- Petitioner Vs • Secretary, Regional Transport Authority Sarguja, Ambikapur, District Sarguja, Chhattisgarh.

---- Respondent For Petitioner :

Shri CJK Rao, Advocate For Respondents-State :

Shri Bhaskar Payashi, PL for the State Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 16/11/2015 1.

Grievance of the petitioner is that he has moved an application before the respondent on 11.08.2015 for grant of regular stage carriage permit on the route Ambikapur to Jashpur with one return trip daily. 2.

Learned counsel for the petitioner would submit that the writ petitions may

be disposed of with a direction to the respondent to decide the said application expeditiously.

3.

Learned State counsel would object to the maintainability of the writ petitions on submission that although the petitioner has applied for regular permit on two different routes, however, he is seeking to obtain permit by using one common vehicle for both the routes which may not be permissible under the law.

4.

In view of the fact that petitioner's application is pending consideration, the present writ petitions are disposed of with a direction to the respondent to decide the petitioner's application and all other applications pending before it for the concerned route, within reasonable time. 5.

It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
