1. The default pointed out by the Registry as of now stands ignored and with the consent of the parties the matter was heard finally at admission stage.
2. The grievance of the petitioner in the present writ petition is the nonsettling of the retiral dues payable to the petitioner on his retirement.
3. According to the petitioner, he stood retired from service w.e.f. 30.01.2021 and though more than 5 months have passed, till date the
retiral dues have not been paid to the petitioner.
4. Given the limited grievance that the petitioner has, this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending, rather ends of justice would meet if the writ petition at this juncture is disposed of directing the respondents 2 & 3 to immediately process the claim of the petitioner so far as the retiral dues payable to the petitioner is concerned.
5. Let the entire retiral dues payable/admissible to the petitioner which includes payment of gratuity, leave encashment, arrears of salary if any, and other dues like settlement of medical reimbursement etc. be settled within an outer limit of 90 days from the date of receipt of a copy of this order, failing which the entire dues payable to the petitioner shall carry interest @ 10% per annum from the date of retirement till the actual payment is made. The interest part shall be recovered from the erring officials who have not processed the claim of the petitioner promptly.
6. With the aforesaid observation, the writ petition stands disposed of. Sd/- P. Sam Koshy Judge Khatai
