(2) This Court by order dated 01.04.2014 permitted the petitioner to withdraw WP(S) No.1249/2014 with liberty to file appropriate petition challenging the order dated 03.02.2014.
(3) The petitioner has filed Annexure P-4, addressed to the Secretary, Legal Aid Committee, High Court of Chhattisgarh, Bilaspur stating inter-alia that the State Cooperative Tribunal has declined to
accept the appeal on the ground of delay.
(4) Learned counsel appearing for the petitioner submits that the petitioner may be permitted to prefer an appeal along with application for condonation of delay before State Cooperative Tribunal, to which, counsel for the State has no objection.
(5) Prayer appears to be fair and reasonable.
(6) The petitioner is permitted to file an appeal along with application for condonation of delay before the State Cooperative Tribunal. If such appeal is filed by the petitioner before the State Cooperative Tribunal, the concerned Tribunal shall consider and decide the same on its own merit and in accordance with law within a period of 90 days from the date of receipt of copy of this order. (7) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
