1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.507/2015 registered at P.S. Bemetara, Distt. Bemetara for the offence punishable under Sections 379, 420, 467, 468, 471, 120-B, 413, 34 IPC.

As per the prosecution case, the applicant being RTO agent used to prepare false and fabricated registration papers which he got issued from RTO on the basis of forged documents which were being supplied by one Anil Shriwas. It is further alleged that the vehicles were stolen by Haider Ali @ Sonu, Guddu and Habib, therefore, the prosecution case is that the applicant is a party to the entire transaction.

Learned counsel for the applicant submits that it is not a case that the allegations of theft are being leveled against this applicant and on the basis of the documents which were being supplied by Anil Shriwas and believing it to be correct discharged his duty as RTO agent and got the RTO registration numbers from the RTO office and his case is entirely different from that of other co-accused.
4. Per contra, learned State Counsel opposes the prayer for grant of
bail.

Considering the memorandum of other co-accused and the role played by this applicant that he being RTO Agent procured registration numbers from the office of RTO on the basis of documents supplied to him and also considering the fact that the charge sheet has been filed and looking to the allegations levelled against this applicant, without any observation on the merits of the case, I am inclined to release him on bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He shall appear before the trial Court on each and every date as may be given by the said court. 7.
