Hon'ble Mr. Justice Parth Prateem Sahu Order On Board 31/05/2021

1. This is second application on behalf of applicant for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.58/2021 registered at Police Station Abhanpur, Raipur for commission of offence punishable under Sections 186, 294, 323, 332, 353, 506 of the IPC.

2. First bail application of present applicant bearing MCrCA No.263/2021 has been rejected on merits vide order dated 1.4.2021.

3. Learned counsel for the applicant submits that this application has been filed mainly on the ground that the applicant has been tested Covid-19 positive, he is home quarantine and he requires medical attention. In support of aforesaid contention, he has also filed medical test report dated 3.4.2021 of applicant.

4. On the other hand, learned State Counsel opposes the submissions made on behalf of applicant and prays for

rejection of bail application.

5. I have heard learned counsel for the parties.

6. Earlier application of applicant for grant of anticipatory bail has been rejected by this Court on merits vide detailed order dated 1.4.2021. Thereafter there is no change in the circumstances so as to consider this second bail application of applicant except that he has been detected Covid-19 positive, which cannot be a ground for grant of anticipatory bail to the applicant. In fact, this application is filed within four days of rejection of first bail application i.e on 5.4.2021. Hence, this repeat second application filed under Section 438 of CrPC for grant of anticipatory bail to the applicant is hereby rejected. Sd-/ (Parth Prateem Sahu) Vacation Judge roshan/-
