1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 47 of 2015 registered at P.S. Narayanpur District Jashpur (C.G) for the offence punishable under Sections 376/34 IPC.

2. As per the prosecution story, one of the co-accused namely Ashish Xalxo has committed sexual intercourse with the prosecutrix for a period from 12.01.2013 to 16.05.2015 and the allegation applicant this applicant is that he helped the main accused and thereby abetted to commit the of offence.

3. Learned counsel for the applicant submit that the bail petition of main co-accused Ashish Xalxo has been allowed by this court in M.Cr.C.No.2996 of 2015 decided on 01.07.2015 on the basis that main accused Ashis Xalxo and the prosecutrix have performed marriage and considering the role played by this applicant, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of

bail.

5. Having regard to the fact that the co-accused against whom the allegation of rape was made has already been enlarged on bail in M.Cr.C.No.2996/2015 and considering the role played by this applicant, I am inclined to release him on bail.

Accordingly, the bail application is allowed and the applicant Anuranjan Minj is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He shall appear before the trial Court on each and every date as may be given by the said court. 7.
