The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.25/2021, registered at Police Station Gandhinagar, District Surguja (CG), for the offence under Section 363, 370, 34 of the Indian Penal Code. 3.

Applicant along with co-accused Fagni (absconding) have abducted three minor girls namely; Sushanti Nageshiya,

MCRC No.2884 of 2021 Niramala Nageshiya & Mahanty Nageshiya on 11th January, 2021 in order to trafficking them to Delhi for providing household work to them.

On the other hand, learned counsel for the State would oppose the bail application.

As per the statements of Sushanti Nageshiya, who is a niece of the applicant, and Nirmala Nageshiya, who is also a close relative of the applicant, they were promised job of maid servant at Delhi, however, before they could be taken to Delhi the police arrested the applicant.

Considering the facts and circumstances of the case, particularly considering the fact that two of the victim girls are close relatives of the applicant; and further considering the fact that the applicant was not successful in taking them to Delhi, as also for the fact that the applicant is in jail since 13-1-2021 and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail. 7.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
