1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.47/2021 registered in Police Station Pandri, District Raipur C.G. for the offence punishable under Section 376(2)(n) of the I.P.C.
2. Prosecutrix, now aged about 25 years was having an affair with the applicant for about four years since after June, 2017. They were working together in a real estate firm. After six months of initiation of affair they decided to marry each other but the families were not agreed and this situation
MCRC No. 2763 of 2021 continued during their affair for rest of the period. The applicant eventually got engaged to some other girl which has prompted the prosecutrix to file the present FIR.
3. Learned State counsel would oppose the prayer for grant of bail.
4. Considering the entire fact situation of the case and for the fact that applicant is in jail since 24.2.2021 and also for the fact that charge-sheet has already been filed, I am inclined to release the applicant on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
