Taking into consideration the evidence led on behalf of the complainant, PW-2 as also shriram Singh, PW-3, this court is of the opinion that arguable points have been raised by the counsel for the appellant assailing the order dated 24.10.2016 passed by the Special Judge (ST & SC Act), Balod in Special Sessions Case No.17 of 2016 acquitting the respondents, and therefore, leave to appeal is granted. Accordingly, CrMP is allowed. Registry is directed to register the case as an Acquittal Appeal.
Acquittal Appeal is also admitted for hearing. Issue notice to the respondents by ordinary mode as well as by registered mode. PF within 10 days. Call for the record.
List it for final hearing in due course.
