1. WPS No.2547/2014 is delinked from the present batch of writ petitions and it be listed for final hearing in due course.

2. The petitioners were working as Security Guard on contract basis in the establishment of National Institute of Technology, (NIT) Raipur.

3. Indisputably, the NIT, Raipur functions under the control of the Department of Higher Education, Ministry of Human Resource Development, Government of India. Thus, the NIT is part of and is an institution of the Central Government.

4. In view of the provisions contained in Article 323-A of the Constitution of India read with Section 28 of the Administrative Tribunals Act, 1985, this Court has no jurisdiction in the matter because in addition to challenge to the recruitment process initiated by the NIT, the petitioners are also claiming issuance of writ of mandamus commanding the respondents to issue advertisement for filling up the posts of Security Guard/Supporting Staff and to provide minimum wages to them. Accordingly, all the writ petitions are dismissed for want of jurisdiction. The petitioners may avail remedy before the jurisdictional Central Administrative Tribunal.
