The applicant has preferred this First bail application under Section 439 of the Cr.P.C for grant of regular bail as he is arrested in connection with Crime No. 40/2017 registered at Police StationKharsiya, District- Raigarh (C.G.) for the offence punishable under Sections 302, 201 and 120(B)/34 of IPC.

As per prosecution story, deceased- Prem Singh was the father of the present applicant. It is alleged that present applicant and his mother, accused- Sushila have committed murder of deceased- Prem Singh. The dead-body of the deceased was burned with an intent to suppress the evidence. The matter was reported and the applicant was arrested on 05/02/2017.

Learned counsel appearing on behalf of the applicant submits that the main accused is the Sushila, wife of the deceased, who has been
granted bail by the trial Court itself vide order dated 13/03/2018. He further submits that the material witnesses have been examined, therefore, this applicant may be released on bail. 4.
Per contra, learned counsel appearing on behalf of the State opposes the bail application.

I have heard learned counsel for both the parties. 6.
Considering the above facts and circumstances of the case, particularly considering the submissions of the witnesses, I am not inclined to release the applicant on bail.
