This petition was filed by the petitioner at the time when Debt Recovery Tribunal was not functioning. On the last date of hearing also, this Court adjourned the matter and interim order was continued in view of the statement that the Officer of the Chairman of Debts Recovery Appellate Tribunal (DRAT), Allahabad, is still vacant. 2.

Today, Shri H.B. Agrawal, Sr. Advocate appearing for respondent No.2 informs the Court that now the DRAT has become functional and has also placed before this Court the order-sheets of DRAT.

A perusal of the aforesaid order-sheets show that the Appellate Tribunal is functioning. Therefore, in these circumstances, I am not inclined to keep this matter pending, this petition is finally disposed off and it is open for the petitioner to prosecute his appeal and pray for interim relief.
