This is an application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No. 224 of 2015 registered at P.S. Urla, District Raipur (C.G) for the offence punishable u/s 34(2) of the Excise Act.

As per the prosecution case, on 11.10.2015 when the raid was conducted by the Police, 9 bulk litres of illicit liquor was seized from the possession of the applicant. Learned counsel for the applicant submits that the charge sheet in this case has been filed and the applicant being a lady aged about 50 years may be enlarged on bail. Per contra, learned State Counsel opposes the bail application. He submits that earlier in the year 2015 itself, the applicant was involved in similar nature of crime and the offence was registered being Crime No.90/2015. Having regard to the fact that in the year 2015 itself

the applicant was inculpated in similar type of crime and after release, she again repeated the offence, I am not inclined to release the applicant on bail.
