Radhakrishnan , Chief Justice 12.04.2018 1) We have heard learned counsel for the appellant and the learned Government Advocate in this appeal against an interlocutory order passed during the course of a Writ Petition under Article 226 of the Constitution.
wa 253 of 2018 2) We have considered the impugned order dated 15.02.2018. It is rendered taking note of relevant facts and factors. Due application of mind is clearly demonstrated through that interlocutory order issued by the learned Single Judge. We have also seen the order impugned in the Writ Petition. We are of the view that no issue has been finally decided and all that has been done by the learned Single Judge was to refuse interim relief against the order of the administration requiring the appellant- Writ Petitioner to give charge of the Block Education Officer, Rajnandgaon to respondent No.4Principal, Government Higher Secondary School, Tadesara. The petitioner has now been directed to work as Principal of the Government Higher Secondary School, Tadesara in the same block. On the totality of the facts and circumstances of the case, we do not see that any injustice results as a consequence of the interlocutory order issued by the learned Single Judge.
3) Hence, this Writ Appeal is dismissed without prejudice to the Writ Petitioner/appellant's eligibility to make any request before the learned Single Judge or to apply for early final disposal of the Writ Petition.
