1. The present review petition has been filed seeking review of the order dated 08.02.2019 passed in WPS No. 851/2019.
2. The contention of the petitioner is that the petitioner infact had originally filed the writ petition seeking for arrears of the benefit of revised pay scale that he had got in the light of the judgment passed by this Court in WPS No.2530 of 2017 (Mukesh Kumar Patel and another Vs. State of Chhattisgarh and another) on 28.11.2017.
which has been implemented in the case of the petitioner prospectively and retrospective benefits has not been granted. However, inadvertently the order which has been passed seems to have been not connecting to the facts of the present case but is an order passed in some other case. Hence, the relief for review of the same has been sought.
3. On due considering the entire facts and circumstances of the case, particularly, taking into consideration the relief sought for in the original writ petition i.e. WPS No. 851/2019 filed by the petitioner, this Court is of the view that the order dated 08.02.2019 is liable to be recalled and accordingly the review petition stands allowed,the order dated 08.02.2019 stands recalled and WP(S) 851/19 be listed for rehearing.
4. Let WPS No. 851/2019 be listed for hearing today itself in the second half.
