The grievance of the petitioner seems to be the action on the part of the respondents No. 3 & 4 who are trying to demolish the construction raised by the petitioner that situates in khasra No. 207/14, admeasuring 0.020 hectare. It appears that the dispute of the petitioner is already seized in an appeal before the Sub-Divisional Magistrate, at Raipur and pending the appeal the present writ petition has been filed.

Taking into consideration the nature of dispute involved in the present writ petition, this Court is of the opinion that it would be more appropriate if the petitioner moves an appropriate interim application in the pending appeal before the Sub-Divisional Magistrate, who shall in turn consider and decide the same in accordance with law at the earliest.

With the aforesaid observations, the present writ petition stands disposed of.
