1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.336/2020, registered at Police Station Gandhinagar, District- Surguja (C.G.) for the offence punishable under Section 21 C of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. Four accused persons have been found in joint illicit possession of 572 vials of Rexogesic Injection, each containing 2 ml liquid

MCRC No. 2799 of 2021 having 3 mg Buprenorphine psychotropic substance. They were also found to illicitly possess 587 vials of Pheniramine Maleate Injection, each containing 10 ml liquid. The total quantity of contraband recovered from the accused persons is 1144 ml, whereas the commercial quantity for the subject psychotropic substance is 20 gm.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Bail application of co-accused of Babita Sahay has been dismissed twice in MCRC Nos.8639 of 2020 and 3933 of 2021, whereas bail application of Akash Rajak has been dismissed in MCRC No.3256 of 2021.

6. Considering the entire facts situation of the case and particularly rejection of the bail applications of the co-accused persons and also the commercial quantity of contraband recovered from the applicant, I am not inclined to release the applicant on bail.
