Learned counsel for the petitioner would submit that the petitioner was transferred from Government Primary School, Gidhauri to Government Primary School, Nayaktad by order dated 08/09/2015 declaring her as surplus teacher whereas by order dated 18/09/2015, respondents No.6 & 7,

namely, Geeta Kanwar & Ku. Vandana Rai Sagar have been transferred to Government Primary School, Gidhauri. Learned counsel for the petitioner would further submit that in order to accommodate respondents No.6 & 7, petitioner has been transferred from Government Primary School, Gidhauri. 2.

Be that as it may, the petitioner is directed to make fresh representation before the Collector, Baloda Bazar-Bhatapara, who is competent authority under the transfer policy, who in turn shall consider and decide the representation of the petitioner within a period of four weeks from the date of filing of the representation.

The effect and operation of the impugned order dated 08/09/2015 shall remain stayed till the representation of the petitioner is decided. 4.

With the aforesaid observation/direction, writ petition stands finally disposed off. It is made clear that this Court has not expressed any opinion on the merit of the case. If the cause of action survives, the petitioner is free to approach before this Court.
