Hon'ble Shri Justice P. Sam Koshy Order on Board 20.05.2020

1. The present MCC has been filed seeking extension of time for the petitioner to vacate the Govt. premises (official quarter, which was earlier allotted) presently occupied by the petitioner. This Court while entertaining WPC No. 545 of 2020 had vide its order dated 05.02.2020 granted ninety days time for the petitioner to make alternative arrangement and to vacate the premises.

2. Today, the counsel for the petitioner submits that on account of the lockdown period imposed by the Government, the petitioner was

-2unable to vacate the premises and shift to a new premises and accordingly prays for limited extension of time for the period during which the lockdown in is operation.

3. The limited prayer made by the counsel for the petitioner is not opposed by the State Counsel.

4. Accordingly, ninety days time period which has been granted by this Court stands extended till the lockdown period is in operation. It is further being made clear that immediately after the lockdown being withdrawn by the Government, the applicant shall immediately vacate the premises and handover peaceful possession to the State authorities without any further delay.

5. The MCC stands allowed and disposed off.
