This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicants have been arrested in connection with Crime No.79/2019 registered at Police Station-Suhela, Balodabazar, (C.G.) for the offence punishable under Section 34(2) of CG Excise Act.

Case of the prosecution, in brief is that on 19.03.2019, 6.120 bulk liters of foreign liquor has been seized from the joint possession of the applicants. 5.

Counsel for the State submits that one another criminal case has been registered against the applicant No.1 Ravi Lalwani under IPC. Two other criminal cases have been registered against the applicant No.2 Ravi Kotwani under IPC. No antecedent has been reported against the applicant No.3 Bhushan. 6.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if applicant No.1 and applicant No.2 furnish two solvent sureties for a sum of Rs. 25,000/- each along with a personal bond of Rs.50,000/- each to the satisfaction of the trial Court concerned with condition that they will not involve in any crime in future, they will appear before the Trial Court at 11:00 am as and when directed till trial and they would cooperate during the trial, they shall be released on bail. It is directed that if applicant No.3 furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of Rs. 25,000/- to the satisfaction of the trial Court concerned, they be released on bail. 7.
